By entering a bid in one of my auctions, you agree to all of the following:
WHO MAY BID:
In accordance with eBay rules, I reserve the right to reject winning
bids from any user with hidden information or negative feedback. If
an auction is still in progress, I may cancel your bid at my discretion
without further notice.
Please e-mail me BEFORE
bidding if you have a number of
negative feedbacks on your profile or if you have no positive feedback
or a small number of positives and have already earned some negatives
(especially for Non-Payment) and if you are a new bidder to eBay
with no positive feedback.
I have gotten five negative feedbacks as retaliation for negatives
I was forced to leave on buyers that i most cases were non-paying
bidders, but that is part of this game. Negative feedback won't necessarily
stop you from bidding, I just want to know why you got it. I reserve
the right to cancel bids from users who have violated the terms of
any of my past auctions, or if an auction has closed and you are
a winning bidder, reserve the right to VOID the auction due to yoru
non-compliance with my Terms. .
WINNING BIDDER:
Will be contacted via email with complete instructions on completing
our transaction and easy links for fast payment using Pay Pal. This
will happen almost immediately on the close of
the auction. If you fail to confirm your win within 72 hours (3 days
people), I reserve the right to declare the auction VOID
and notify eBay that our transaction was not completed successfully
and you have violated my Terms & Conditions.
If you bid on an item, I would imagine it is because you want it
and three days should be more then enough time to simply acknowledge
your win and let me know how you intend on paying for it...don't
you agree?
Payment must reach me within
7 days from the close of the auction
or again this might VOID
our transaction. Certainly it shouldn't take more then a day or
so to mail payment and Pay Pal makes it easy to pay instantly.
I have found anyone stringing me out beyond 7 days or longer is
usually a Non-Paying
Bidder or someone that didn't intend
on honoring the win or didn't have the money to pay for the win
and shouldn't have bid in the first place. Unfortunately the numbers
of Non-Paying bidders keep growing so I have found it necessary
to tighten my terms regarding payment.
Failure to honor a winning bid or any
of these terms may result in negative feedback
and notification to eBay that you are either a "Non
Paying Bidder"
or you have not responded to my email and the auction was declared
VOID.
In some cases a buyers contact information or
email address has not been updated and they have not received any
notification about their win. In most cases after many attempts
by email I will actually attempt to call the buyer to resolve the
issues. If there is an incorrect phone contact on file with eBay
I will report that to eBay as well in hopes of getting correct
contact information. I will do everything in my power to contact
you and have you abide by the Terms you have agreed to before leavig
negative feedback or reporting a problem to eBay.
In the rare event
that you can't honor your win and there is an extenuating situation,
at my option, I will offer you a release on your obligation but
there will be a 15% handling fee to do this. This will cover
my time in running the auction, insertion fees eBay has charged
me (which is not refundable) and and other time and expenses I
might have incurred. If this option is taken, I will report to
eBay that we both agreed not to complete the transaction and no
feedback will be left on your profile (negative or positive) and
you will be off the hook. The 15% fee must be paid using Pay Pal
and I will be happy to issue a payment request.
This opton, I have found, is a fair way for those
people that for some legitimate reason just can't complete the transaction.
If I feel they are basically good guys or gals and honorable, I will
accept ths option.
Remember this option is at my discretion and not
an easy way out for Non-Paying Bidders.
The 15% fee also covers any returns I agree to (other then legitimate
returns for damaged goods, etc.) and will be considered a restocking
fee.
